The Terms of Use ("Terms") below are applicable to the Whiting Foundation (the "Foundation", "we", "us", "our") website, located at www.whiting.org (the "Site"). Please read these Terms carefully before using the Site. By accessing or using the Site, you hereby agree to be bound by these Terms, as well as our Privacy Policy. This Site is operated and controlled by the Foundation in the United States, and the Foundation’s databases are located in the United States. Governing Law / Forum
These Terms are governed by the laws of the State of New York. Any dispute regarding these Terms of Use or your use of the Site shall be resolved solely in the state or federal courts located in New York, New York. You agree to waive trial by jury in any such action.
General Provisions
Nothing in these Terms may be deemed to create an agency, partnership, joint venture, employee-employer or similar relationship of any kind between the Foundation and you. The failure of either party to assert any right under these Terms will not be considered a waiver of that party’s right, which will remain in full force and effect. You may not assign your rights under the Terms without the Foundation’s prior written consent, and any attempted assignment in violation of this provision is null and void. The Foundation may assign these Terms and transfer any of its rights or obligations at any time for any reason.

Please report any violations of these Terms to us at info@whiting.org. We reserve the right to report any unauthorized use of the Site to appropriate authorities.
